I. GENERAL PROVISIONS
COLLEGIUM MONDIAL TRAVEL travel agency d.o.o. (hereinafter: CMT or the agency) is a travel agency that has been organizing trips, excursions, and festivals for more than 20 years. CMT's travel packages are primarily intended for young people, university students, and high school students, unless the program's content indicates otherwise. To ensure uniform operation of CMT as an agency in individual travel packages with travelers, CMT has adopted the General Terms and Conditions of Travel, which regulate contracts for travel with travelers. These CMT General Terms and Conditions are an integral part of the contract that CMT and the traveler conclude upon registration for a specific package. The traveler can become acquainted with the provisions of these general terms and conditions at the CMT office, on the contract, or online on CMT's official website and on any other website where CMT, as a provider of its own or third-party tourism packages, offers its services, and where the CMT General Terms and Conditions are specifically marked and publicly accessible. The content of individual travel contracts cannot be determined in a manner that contradicts the adopted general terms and conditions, except with special written consent from CMT. These general terms and conditions apply to all future travel contracts with travelers.
II. CONCLUSION OF THE TRAVEL CONTRACT
A traveler can register for a tourism package at CMT offices, at any authorized agency, with a person who acts as an intermediary for CMT's services, or online on CMT's official website or on any other website where CMT, as a provider of its own or third-party tourism packages, offers its services. A complete registration for a package is considered a written or oral confirmation of registration, or, if the registration was made via an online form, a confirmation sent to the email address, and payment of 30% of the total package value (hereinafter: the deposit) no later than 24 hours after registration. Providing the necessary information and timely payment of the deposit constitutes a complete registration.
Upon complete registration, CMT and the traveler conclude a travel contract, which is sent to the traveler by email in the case of registration by phone or online, or handed over in physical form if concluded in person. Should the traveler wish to have the documentation printed and sent by mail, CMT will charge a flat fee of 5.00 EUR for printing and postage costs. The travel contract contains information about the traveler's package or refers to the package program or offer where this information is listed. If the deposit is not paid within 24 hours of receiving the registration, the traveler is considered not to have registered for the package. The concluded travel contract guarantees the traveler participation or a place on a specific tourism package, provided that the traveler also pays the remaining amount within the set deadline and that the trip is actually carried out.
For the purpose of defining a complete registration, the day of payment is considered the day the traveler makes the payment at a CMT office or an authorized agency, or the day the payment is executed to CMT's account. The traveler is obligated to pay the remaining balance of the package value no later than 30 days before the start of the trip, unless otherwise specified in the program or contract. The traveler can pay with cash or another specified payment method. In accordance with the business conditions of financial institutions, in the case of a cash or non-cash payment (credit cards, Maestro, BA, etc.) for a tourism package or other service, CMT will in no case issue a cash refund. When an authorized travel agency books a tourism package for a traveler, all provisions of this section of the general terms and conditions also apply to the authorized travel agency. In the event that the traveler uses PayPal as a payment method for online registration, an additional 3.5% of the payment amount is added to the total payment as a fee for payment transaction costs (the so-called "payment fee"). Upon registration, the traveler pays a registration fee (a so-called "booking fee") of 10 EUR per person, or 7% of the total amount on the registration form, or another value specified in the program or special conditions that apply to the individual package. If the traveler fails to pay the remaining balance of the package value by the agreed-upon deadline, the traveler is considered to have failed to fulfill their obligations under the travel contract, and CMT may cancel their trip as of the due date of the remaining balance. This cancellation will be considered a traveler's cancellation of the trip.
The traveler is responsible for all costs and consequences resulting from incorrect information, if the traveler does not provide correct data upon registration. The traveler can withdraw from the contract only in accordance with the provisions on traveler's cancellation of travel. If the traveler fails to pay the remaining part of the contractual obligation by the deadline, CMT reserves the right to refuse the traveler's participation in the trip.
Upon registration for a tourism package, these general terms and conditions apply, as do the special terms and conditions and the offer stated in the package. The traveler is considered to have accepted the provisions of these general terms and conditions the moment they submit a registration for the individual service.
III. PACKAGE PRICES
Package prices are determined in the programs and are valid from the date of publication of the program. Prices for all packages are listed in EUR. CMT reserves the right to change prices in accordance with the Consumer Protection Act (hereinafter: ZVPot-1) due to changes in the cost of transport, fuel or other energy sources, the level of taxes for travel services included in the contract imposed by third parties not directly involved in the performance of the tourism package, including tourist taxes, landing fees for embarkation and disembarkation at ports and airports, or foreign exchange rates related to the tourism package. The price increase is calculated using the same percentage as the increase in the aforementioned calculation elements. CMT will inform the traveler of any potential price changes no later than 20 days before the start of the trip.
If the increase in the agreed-upon price exceeds 8%, the traveler may, no later than 2 days after receiving the notice of the price change, withdraw from the contract in writing without cost. In the event of withdrawal, the traveler is entitled to a refund of the paid amount, without the right to compensation for damages and any costs for visas, insurance, vaccinations, and similar expenses, as well as payment transaction costs related to the payment of the package.
CMT may stipulate in the program that the traveler pays for services to be performed abroad directly to a foreign entity on-site, as foreseen by the program. In this case, CMT acts only as an informer, and the traveler must assert any claims for complaints on-site and with the service provider (abroad). CMT may determine the price of a package in the program and explicitly state that the price may be reduced or increased if a certain number of travelers do or do not register, or when other precisely defined conditions are met. Such a provision in no way guarantees that the conditions for a price reduction or increase will occur. The traveler cannot withdraw from the contract for the reason that the conditions for a potential price reduction did not occur.
In addition to the basic package price, the traveler is also obligated to pay all mandatory surcharges (visas, etc.), which, if not already included in the basic package price, are added to the basic price of the tourism package in the travel contract along with any optional surcharges to form the final price, and thus represent the traveler's final obligation based on the travel contract. Upon registration, the traveler may indicate a desire for special services (such as special dietary requirements, a change of meal plan, etc.), which, when possible in a particular package, are paid as a supplement to the basic price of the package. The traveler pays for special services upon registration, or may pay a supplement during the trip (in the appropriate currency) to the tour leader or a CMT representative at the location where the services are provided, if this is specified in the program or offer.
IV. SERVICE CATEGORIZATION AND "NO NAME" ACCOMMODATION
The categorization of accommodation facilities (number of stars or object categorization) listed in CMT programs for individual packages signifies classifications in accordance with the official national categorization in individual countries, valid at the time of program publication. The agency draws attention to the differences in categorization criteria in some tourist destinations, as higher standards apply in the Republic of Slovenia and in most Western European countries.
"No name" packages are those where the name of the accommodation facility (apartment, hotel, etc.) is not listed in the program, and CMT reserves the right to inform the traveler of the name of the accommodation facility only upon arrival at the destination. For these packages, the organizer guarantees the information provided in the contract, which includes at least:
• the category of the facility,
• the room type,
• the service at the hotel (overnight stay, half-board, "all-inclusive," etc.),
• the location of the accommodation.
Unless otherwise specified in the program, the prices for a given tourism package are per person for accommodation in multi-bed rooms (which may also have extra beds). A returnable security deposit is mandatory for all programs as a guarantee against property damage (from 20.00 EUR per person onwards, in accordance with the requirements of the accommodation facility).
V. TRAVELER'S CHANGE OF REGISTRATION AND CANCELLATION OF TRAVEL
The traveler may withdraw from the travel contract at any time before the start of the trip, in which case CMT may require the traveler to pay an appropriate and justified cancellation fee. The traveler has the right to cancel the trip at the registration point where they registered and concluded the travel contract.
Any change or substitution of the program after the conclusion of the travel contract that is not confirmed by the agency is treated as a cancellation of the travel contract, even if the traveler later re-registers. If the change is minor and does not lead to a change in the essential items of the package that would result in additional costs or prevent the trip from being carried out, CMT may confirm the change but will charge an administrative fee for the change:
• up to 30 days before departure: 15.00 EUR,
• 29-10 days before departure: 30.00 EUR,
less than 9 days before departure: changes are not possible, and any change is considered a withdrawal from the contract. If the parties agree on any change, an administrative fee of 30.00 EUR will be charged.
If the program specifies different conditions for the reimbursement of costs due to cancellation of the travel contract, the conditions specified in the program (special conditions) apply.
Upon cancellation of the travel contract, the traveler must sign a cancellation document on a prescribed form, which is offered for signature by the sales consultant and is an appendix to these general terms and conditions. If the traveler refuses to sign this document, they are considered not to have canceled the travel contract.
During the trip, the traveler may interrupt the trip at their own request and with a written statement of interruption. If the traveler interrupts the trip during its course, they are not entitled to a refund of costs or the purchase price, neither in part nor in whole, upon return.
If the traveler, at their own request, changes the program during the trip or does not travel according to the program that is an integral part of the contract with CMT, the traveler is considered to have withdrawn from the contract during the trip. In this case as well, they are not entitled to a refund of costs or the purchase price, neither in part nor in whole. However, the traveler is responsible for the costs and damages they have caused by the change of program.
In the case of a change of program at one's own request, without there being reasons on the part of CMT due to an improperly performed service, the traveler has no right to demand any compensation or price reduction.
The traveler has the right to cancel the trip before departure at the office where they registered, or by email. The cancellation must be in writing. In this case, CMT has the right to reimbursement of costs due to the cancellation of the trip, the amount of which depends on the time before the day of the start of the service in which the traveler canceled the travel contract. If not otherwise specified in the program or on the registration form for a particular package, the following cancellation costs apply, which are in no case lower than 20.00 EUR per person for individual and announced packages and 75.00 EUR per person for programs created for groups:
For individual and announced packages (general scale of cancellation fees, Collegium):
• up to 60 days before departure - administrative costs of 20.00 EUR (per person),
• 59 to 45 days before departure - 30% of the package price,
• 44 to 30 days before departure - 50% of the package price,
• 29 to 15 days before departure: 70% of the package price,
• 14 to 8 days before departure: 80% of the package price,
• 7 to 1 day before departure: 100% of the package price,
• on the day of departure and after departure: 100% of the package price.
For programs created for groups (Mondial, Cooltura):
• up to 90 days before departure: administrative costs of 75.00 EUR (per person),
• 90 - 71 days before departure: 60% of the package price,
• 70 - 45 days before departure: 80% of the package price,
• 44 - 1 day before departure: 90% of the package price,
• on the day of departure and after departure: 100% of the package price.
For tourism services within festivals (festivals in Novalja, Travel2Ultra):
• up to 90 days before departure: administrative costs of 30% of the package price,
• 90 to 61 days before departure: 60% of the package price,
• 60 to 1 day before departure: 100% of the package price,
• on the day of departure and after departure: 100% of the package price.
In the event that a traveler does not start the agreed-upon service at the time specified in the program, in the departure notice, or in the travel contract, they are considered to have withdrawn from the travel contract and waive the right to a refund of the paid amount or the corresponding difference, as described above. This does not apply if the traveler has timely reported a "late check-in" or a change to the reservation and has received a written confirmation of the change from the agency. A withdrawal from the travel contract is considered to have occurred if the traveler does not check in to the accommodation facility by 7 PM on the day of arrival as per the contract, unless otherwise specified in the program, departure notice, travel contract, or similar document. A withdrawal from the contract is also considered to have occurred if the traveler does not show up for the departure of the means of transport (bus, train, plane, ship) at the time specified in the program, departure notice, travel contract, or other similar document, or if they do not take up the ordered other service at the time specified in the program, departure notice, or travel contract.
The traveler is obligated to provide all necessary information for the refund of the difference in the written cancellation. If the traveler does not provide the information within 21 days of sending the cancellation, the traveler is considered to have waived the right to a refund of the difference. Cancellation costs always include at least the administrative costs.
If a registered traveler knows in advance that they will not be able to participate in the trip, they have the right to find a person who will enter into the travel contract in their place up to 10 days before departure, provided that the tour organizer agrees to the change. The tour organizer may refuse the replacement of the traveler in the case of an assessment of excessively high logistical costs. A name change is only possible in person by the reservation holder at a CMT sales point upon submission of a written statement and the personal documents of both persons. In this case, CMT will charge the traveler only for the costs of the change. After the conclusion of the contract, the traveler can change the name or number of travelers and the accommodation, but only on the condition that such a change is possible without canceling the package. For each change, CMT will charge the traveler an administrative fee for the change. In cases where the costs of the change are higher, especially when the package also includes transport by plane or the organization of certain activities at the destination, and costs also arise due to cancellation and change by the service providers, CMT will, in addition to administrative costs, also demand reimbursement of the actual costs incurred due to the change.
In the event that the traveler, at their own request, withdraws from the rest of the trip in writing (a statement of interruption), they are not entitled to a refund of the costs of the paid package upon their return. A lack of snow is not considered a reason that would qualify as force majeure, so in the event of a traveler's cancellation of a trip, CMT will act in accordance with the provisions on the traveler's change or cancellation of the trip. In cases where the package organizer is another travel agency for which CMT is an authorized representative, its general terms and conditions also apply, with which the traveler is made aware upon concluding the contract.
VI. INSURANCE
Package prices, unless otherwise specified in the program, include basic accident insurance but do not include health insurance, which means that travelers must arrange for health insurance themselves. For trips abroad, we recommend health insurance with assistance abroad. Also, the package price does not include travel cancellation risk insurance, which the traveler can purchase themselves upon registration. In the event of the death or illness of the traveler or close relatives, the insurance company will, based on an appropriate certificate (medical certificate, death certificate), reimburse the costs of canceling the trip. The general terms and conditions of the insurance company that concludes the relevant insurance are available at the point of sale.
For travel packages that also include travel cancellation cost insurance, the insurance premium is included in the price of the package. When a claim is made under the insurance, the cost of the insurance premium is deducted from the package costs that the insurance company reimburses due to the cancellation of the trip.
CMT does not provide any medical assistance. If the traveler is not covered by additional health insurance but needs urgent medical assistance during the trip, they are obligated to cover the costs incurred themselves.
TRAVEL CANCELLATION COST INSURANCE
Upon registration, the traveler can conclude travel cancellation cost insurance with a contractual insurance company in case the traveler cancels the trip due to unforeseen events. The insurance is concluded only if it is concluded at the same time as the travel contract and the premium is paid on that day. Coverage is provided for the following unforeseen events:
a) an accident, death, or an unexpected worsening of the insured person's health that prevents them from traveling;
b) an accident, death, or an unexpected worsening of the health of the insured person's children, parents, siblings, spouse or common-law partner, or grandparents, which prevents the insured person from traveling, on the condition that the insured person is obligated to care for the aforementioned persons in the event of an accident or such a worsening of their health, which must be evident from a medical certificate;
c) a summons from judicial or administrative authorities where the personal presence of the insured person is mandatory;
d) a natural disaster or force majeure that prevents the insured person from traveling;
e) an accident, death, or an unexpected worsening of the health of a fellow traveler(s) (when up to 6 people are traveling) who are not in a family relationship (e.g., boyfriend and girlfriend who do not live in the same household or friends, etc.) or are in a broader family relationship with the insured person, provided that they are listed together with the insured person on the registration form and in the travel contract itself;
f) a retake exam for high school where the deadline for taking the exam occurs during the graduation trip or within 21 calendar days after the completion of the graduation trip. The coverage is only valid for graduation trips that take place in June, July, August, or September of each year.
HEALTH TREATMENT COST INSURANCE ABROAD WITH ASSISTANCE "TUJINA"
The insurance includes the following coverages: 24-hour assistance in Slovene, organization of medical assistance, notification of the insured person and their loved ones, and coverage of the costs of emergency treatment, medical care, medicines and medical devices, transport of loved ones, escort of children, return to the home country or transport of remains to the home country, and search and rescue in the mountains and at sea.
The insurance is concluded with GENERALI zavarovalnica d.d. (more about the insurance company at www.generali.si) under the conditions 01-OTP-01/20, 01-TUJ-01/24 and clauses 03-OTP-095/23, 03-TOS-01/21, with which the traveler explicitly agrees upon concluding the insurance. The traveler is informed about the main features of the insurance in the documents with information on the insurance product IPID-ODPOVED TP and IPID-TUJINA. All these documents are published on the CMT website: https://www.collegium.si/pogoji-poslovanja/. The traveler reports the occurrence of an insured event via an e-report or a form that is available on the insurance company's website (Report a claim, quickly and easily - Generali - Generali).
Important: The condition for a refund of the paid amount under the travel cancellation cost insurance is a written cancellation of the trip, which must be submitted no later than 7 days from the day one of the above-mentioned cancellation reasons occurred.
VII. CANCELLATION OF TRAVEL OR CHANGE OF PROGRAM
Based on valid legal regulations, CMT reserves the right to cancel a trip due to unavoidable and/or extraordinary circumstances that make it impossible to fulfill the travel contract, or in the case of an insufficient number of registered persons for the trip to be carried out:
• 20 days before departure for trips longer than 6 days,
• 7 days before departure for trips lasting 2-6 days,
• 48 hours before departure for trips shorter than 2 days.
Unless otherwise specified in the program, the minimum required number of travelers on a specific means of transport is:
• for bus trips: at least 40 travelers,
• for trips on regular airline routes: at least 20 travelers,
• for trips with special planes, trains, or ships: at least 80% occupancy.
CMT reserves the right to fully or partially withdraw from the contract if, before or during the execution of the program, extraordinary circumstances arise that could not have been expected, removed, or avoided, and for CMT, these circumstances represent a justified reason not to have concluded the contract if they had existed at the time of its conclusion. CMT reserves the right to change the day or time of departure due to a change in the timetable of the means of transport used or the occurrence of force majeure, and the right to change the direction of travel if the conditions for travel change (new timetable, uncertain situation in the country where the program is organized, natural disaster, or other unforeseen causes that CMT cannot influence), without special compensation and in accordance with valid regulations in passenger traffic. CMT is not liable and assumes no obligation for compensation for damages to registered travelers for delays of planes, ships, trains, or for flight cancellations, nor for program changes that would result from such delays or cancellations. In these cases, CMT assumes no obligation for compensation for damages to registered travelers, but will refund the full paid amount. In cases where CMT explicitly guarantees a departure in writing, it cannot cancel the trip.
CMT reserves the right to fully or partially withdraw from the contract during the trip if a traveler endangers the well-being and health of other travelers and, through their behavior, prevents the service provider from carrying out the program on behalf of the agency. In these cases, the traveler is not entitled to a refund of the paid amount.
VIII. INFORMATION
The offered combination of travel services is a tourism package in the sense of the law governing consumer protection. The traveler is entitled to all EU rights that apply to tourism packages. CMT d.o.o. assumes full responsibility for the proper execution of the tourism package as a whole. In accordance with the law governing consumer protection, the agency provides a guarantee that, in the event of its liquidity difficulties, all payments to the traveler will be refunded and their return will be ensured when the tourism package includes transport.
CMT d.o.o. guarantees the consumer the following key rights:
Travelers receive all essential information about the tourism package before concluding the package travel contract.
At least one company is always responsible for the proper performance of all travel services included in the contract.
Travelers receive an emergency telephone number or contact point details through which they can get in touch with the tour organizer or travel agency.
Travelers can, with a notice within a reasonable time and upon payment of any additional costs, transfer the tourism package to another person.
The price of the tourism package can be increased only if specific costs arise (e.g., fuel prices) and if this is explicitly stated in the contract, but in no case later than 20 days before the start of the tourism package. If the price increases by more than 8 percent of the tourism package price, the traveler can withdraw from the contract. If the tour organizer reserves the right to increase the price, the traveler has the right to a price reduction if the relevant costs decrease.
Travelers can withdraw from the contract without paying any cancellation fee and receive a full refund of all payments if any of the essential elements of the tourism package, other than the price, have changed significantly. If the company responsible for the tourism package cancels this tourism package before its start, travelers are entitled to a refund of payments, and where appropriate, to compensation for damages.
Travelers can withdraw from the contract at any time before the start of the tourism package without paying any cancellation fee in the event of extraordinary circumstances, for example, if serious security problems arise at the place of travel that would likely affect the tourism package.
In addition, travelers can withdraw from the contract at any time before the start of the tourism package against payment of an appropriate and justified cancellation fee.
If essential elements of the tourism package cannot be provided as agreed after its start, suitable alternative arrangements must be offered to the traveler without additional cost. Travelers can withdraw from the contract without paying any cancellation fee when the services are not performed in accordance with the contract and this significantly affects the performance of the tourism package, and the tour organizer does not remedy the issue.
Travelers are also entitled to a price reduction and/or compensation for damages when the travel services are not performed or are inadequately performed.
If the traveler is in difficulty, the tour organizer must provide assistance.
If the tour organizer or travel seller, when providing a guarantee in the event of liquidity problems, has liquidity problems, payments will be refunded. If the tour organizer or travel seller, when providing a guarantee in the event of liquidity problems, has liquidity problems after the start of the tourism package and transport is included in the tourism package, the return of the travelers is ensured. CMT d.o.o. has provided a guarantee in the event of liquidity problems with Zavarovalnica Triglav, d.d., Miklošičeva 19, 1000 Ljubljana. IX. PRE-DEPARTURE NOTICES
Travelers receive a pre-departure notice by email (if they provided their email address upon registration), otherwise the notice can be picked up at the agency's office or the agency can be contacted by email at info@collegium.si or by phone at 070-554-554. CMT does not send pre-departure notices to travelers by regular mail, unless otherwise specified in a particular program.
CMT sends pre-departure notices to its travelers no later than five (5) to seven (7) days before the start of the trip, unless otherwise specified in a particular program. Pre-departure notices for one-day excursions and for all packages in Slovenia with self-arranged transport are sent no later than two (2) days before the start of the trip. If the traveler does not receive a notice to their email address up to three (3) days before departure, they are asked to visit the agency's office or contact the agency at the email address and/or phone number listed above. The traveler is responsible for any damage that would result from the traveler providing an incomplete or incorrect address (postal and/or email) for the purpose of fulfilling the contract.
X. TRAVEL DOCUMENTS AND OTHER TRAVELER OBLIGATIONS
Before concluding a package travel contract, CMT d.o.o. provides the consumer with information on travel documents and any visa requirements, including the estimated period for obtaining visas, which apply to citizens of the Republic of Slovenia, as well as the health formalities that are necessary for travel and stay at the destination.
In the event that individual countries condition entry into the country with special documents (visas), the traveler is obligated to obtain these documents before the trip or by the deadline specified in the program. Likewise, travelers who are not EU citizens must arrange all necessary travel documents required by the countries they are traveling to. Minor travelers are obligated to arrange all necessary documentation for the passage of minors across state borders. If the traveler does not fulfill the listed obligations or cannot participate in the trip due to incomplete documents, or must interrupt the trip for the same reasons, CMT will act in accordance with the provisions on the traveler's change of registration and cancellation of the trip (see section V. of these general terms and conditions). If CMT acts as an intermediary for obtaining a visa for a traveler, the agency does not guarantee the successful acquisition of the visa. Intermediation for obtaining a visa is not included in the price and is paid separately, and the agency will in no case refund the costs of intermediation.
If a traveler loses their documents during the trip or they are stolen and are indispensable for further travel or for return to the home country, the traveler must obtain new ones at their own expense. For arranging the formalities related to this, the traveler can turn to the tour leader or a representative at the CMT travel agency for advice and assistance. If the traveler has to interrupt the trip due to the loss or theft of documents, they are not entitled to a proportional refund of the paid trip. The traveler is obligated to ensure that they personally, as well as their documents and baggage, comply with the conditions stipulated by the border, customs, health, and other regulations of their own country, as well as the country they are traveling to or through.
Due to the requirements in international passenger traffic (air, ship, bus, etc.), the traveler is obligated to provide all necessary information about all participants they are registering at the time of registration. The data must fully and accurately match the data in the official documents that the trip participants are obligated to carry with them in accordance with regulations on crossing state borders and relevant foreign regulations. If incorrect information causes a delay, additional costs, or interruption of the trip, the traveler alone is responsible for all costs incurred for the trip participants. The traveler is obligated to obtain visas for the countries they are traveling to and to undergo any vaccinations required for those countries before the trip or by the deadline specified in the program.
The traveler is obligated to respect the house rules in catering and accommodation facilities and to cooperate in good faith with the organizer's representative and the service provider. If the traveler does not comply with their obligations, they are liable to the organizer for any damage caused, and the organizer disclaims any liability for damage that the traveler might suffer in such a case. During the trip, the traveler is obligated to behave in a way that does not endanger the life or health of their fellow travelers and does not endanger the course of the trip itself. If the traveler behaves contrary to this provision, the organizer's representative has the right to exclude them from further travel without a refund of any costs, except for payments that are made on-site.
The traveler is obligated to respect the customs and foreign exchange regulations of the Republic of Slovenia, as well as the countries they are traveling to. If the traveler is unable to continue the trip due to non-compliance with these, they will bear all consequences and costs incurred in this regard.
XI. HEALTH REGULATIONS AND TRAVELER'S HEALTH STATUS
In accordance with World Health Organization regulations, a traveler must meet certain conditions (vaccinated, recovered, and/or tested) and provide a corresponding document for travel to specific countries. Compliance with these conditions is mandatory even if such a regulation is adopted after the conclusion of the travel contract. Refusal to comply is not a justifiable reason for contract termination, unless there are contraindications for the traveler's health. In that case, the traveler must submit a medical certificate. If certain vaccinations are listed or required in the travel program, each traveler must obtain an international certificate—a yellow booklet—with the completed vaccinations noted. CMT is not responsible for any complications or the traveler's trip interruption that would result from non-compliance with the health regulations of the country being entered, nor for the costs associated with it.
CMT assumes no responsibility for the worsening of a traveler's pre-existing health conditions, especially those about which the traveler did not inform the agency before the trip. If a traveler takes medication regularly, they are responsible for obtaining a sufficient quantity for the entire trip. In case of health problems, the traveler can consult with the guide or the first aid team, if present at the destination, who will direct the traveler to a local doctor. If, after consulting with a local doctor, CMT believes that the traveler is not able to continue the trip, it may, at its own discretion, advise them to interrupt the trip and return home at the traveler's expense, without a refund of the costs of the interrupted trip. If the traveler does not wish to interrupt the trip, CMT assumes no responsibility for any potential health complications.
Travelers who participate in a trip or activity are aware of the risks that each individual trip entails and participate at their own risk. Risks that exclude the agency's liability include injury, illness, or death of the traveler. The traveler agrees that the agency, its employees, and external collaborators are not responsible for damage to the traveler's property, for injuries, illness, or death of the traveler that arise in connection with the traveler's actions, and CMT is also not responsible for damage that would arise for any reason whatsoever.
(On trips where it is explicitly noted in the program, CMT provides a 24-hour presence of a first aid team composed of young doctors and medical students. The first aid provided by the members of this team represents lay first aid and not professional emergency medical assistance, which is available to travelers only at health centers and hospitals. Members of the first aid team who do not have a license or permission to independently perform medical services do not advise travelers to take medications intended for self-treatment; the traveler is expected to be sufficiently informed about self-treatment themselves. If a traveler decides on self-treatment, the first aid team provides them with such medications for self-treatment. Basic medications, such as mild analgesics, antispasmodics, and antihistamines, can only be prescribed by the traveler's attending physician or the nearest physician at the time of the trip who has the necessary authorization for independent practice. CMT ensures the provision of appropriate information about health services at the place of travel. Wound care, suturing, and the administration of local anesthetics may only be performed independently by a doctor who has a license to independently practice medicine. Each traveler is obligated to familiarize themselves with the detailed rules and health instructions of the first aid team, which are available at CMT offices, at any authorized agency or person, or online on the official CMT website. The traveler is considered to be informed of and to agree with the rules and instructions of the first aid team by agreeing to these general terms and conditions.)
CMT provides first aid for minor injuries on some packages.
XII. LUGGAGE
The transport of luggage up to a certain weight, as determined by the carrier, is free of charge. For air travel, the traveler has the right to free transport of a certain weight of luggage (according to the carrier's regulations), and the traveler pays for each additional kilogram themselves, on-site, in the appropriate currency or according to the airline's regulations. Children under two years of age are not entitled to free luggage transport.
CMT assumes no responsibility for lost or damaged luggage. The traveler reports lost or damaged luggage directly to the carrier or the accommodation facility. For air transport, the airline is solely responsible for luggage, based on the regulations that apply in international air passenger traffic. In case of luggage loss, the traveler fills out the airline's PIR form and submits the completed form to the airline's representative, keeping one copy for themselves. Based on the form, the airline pays compensation to the traveler according to the regulations that apply in international passenger traffic. CMT is not responsible for the theft or damage of a traveler's luggage or other personal belongings, valuables, and documents in the means of transport (on the bus, train, ship, plane) and in or from the accommodation facilities (hotel rooms, apartments, etc.).
XIII. COMPLAINTS (Remedy of Non-conformity)
Every traveler who has concluded a travel contract has the right to a remedy for non-conformity if the travel service is not performed in accordance with the package travel contract. A traveler who has reported non-conformity to CMT and set a reasonable deadline for its remedy, but CMT does not remedy it, has the right to demand a price reduction and compensation for damages. The traveler does not have to set a reasonable deadline for the remedy of non-conformity if the non-conformity is of such a nature that it must be remedied immediately. The traveler may request a price reduction or compensation for damages due to non-conformity with the package travel contract within the legal deadline.
In accordance with the provisions of applicable legislation, the amount of monetary compensation for damages caused due to non-conformity with the contract is limited to three times the amount of the total price of the tourism package, except for compensation for personal injury and for damage caused intentionally or negligently. This provision does not apply if CMT has the right to cancel the package or change the program, in accordance with the provisions of these general terms and conditions and the law. The limitation of liability applies to all trips for which a travel contract is concluded.
The agency does not recognize any Alternative Dispute Resolution provider (IRPS) as competent to resolve any dispute regarding a traveler's claims related to the trip. Link to the online dispute resolution platform: https://ec.europa.eu/consumers/odr/main/?event=main.home2.show.
XIV. CARRIER PUNCTUALITY
The carrier reserves the right to change the timetable, types of aircraft, carrier, and flight path (intermediate stops, flights via another airport, etc.) that occur for various technical and organizational reasons. Delays can also occur, most often as a result of airspace congestion, strikes, and bad weather, over which the organizer has no control. (Changes from the previous paragraph in tourism packages do not count as a change to the travel program, as the first and last days of the trip are intended exclusively for arrival and departure to and from the destination and related transport, and not for rest).
In the event of denied boarding, flight cancellation, or a significant delay in air transport, the traveler may, in accordance with Regulation (EC) No 261/2004 of the European Parliament and of the Council of 11 February 2004 establishing common rules on compensation and assistance to passengers in the event of denied boarding, cancellation or long delay of flights, claim compensation from the actual airline (either via the airline's website or through a specialized intermediary), even when such a flight is an integral part of a tourism package. Compensation for damages or price reductions that the consumer receives on the basis of the ZVPot and regulations and international conventions are deducted from each other to prevent excessive payments.
XV. SPECIAL CONDITIONS FOR TOURISM PACKAGES
If the agency has special conditions for a certain package, they are published on the official CMT website under the general terms and conditions. The published special conditions apply to certain individually listed tourism packages in the part that differs from the general terms and conditions; otherwise, the general terms and conditions or the provision in the individual program also apply to these packages if it is otherwise stipulated there.
XVI. TRAVEL OF MINORS
Minors travel with the agency only exceptionally, if it is so stipulated in a particular program. If any of the persons traveling abroad under the organization of CMT is under 18 years of age at the time of the trip, they are obligated to bring with them to departure a correctly completed certificate or statement with which the parents or guardians of the minor consent that the minor travels under the organization of CMT at their own risk or at the risk of the parents or guardians. If the minor does not have this certificate with them, they cannot travel with CMT, and CMT reserves the right to dismiss them before departure without special compensation.
XVII. ENSURING TRAVELER SAFETY
Each traveler is obligated to take care of their own safety and avoid any actions that could endanger their safety or the safety of anyone else. On certain trips, when explicitly stated in the program, CMT provides for the security of travelers through external collaborators who take care of and provide security.
XVIII. TICKET SALES
By purchasing a ticket from CMT, the buyer accepts the house rules of the event venue as well as the terms of cooperation between CMT and the event organizer. Upon leaving the event venue, the ticket loses its validity. Non-compliance with house rules and ticket misuse are punishable, and the person will be removed from the venue. In such cases, the ticket cannot be refunded. In the event of a complete or partial cancellation or postponement of the event, the deadlines and conditions of the individual event organizer apply. The ticket buyer obtains information about this from the organizer or at the point of sale where they purchased the ticket. CMT is only an intermediary in ticket sales and is not responsible for refunds. Minor or objectively justified changes to the lineup or program are reserved. In the event of a cancellation, postponement of the event, or change of lineup, the ticket buyer is not entitled to a refund of costs (i.e., arrival, hotel). During TV broadcasts, the visitor allows unlimited recording time without the right to demand compensation for the broadcast from the TV organization that produces the film and has filmed the visitor during or in the context of the event and allows the use of all technical means for film processing.
The bringing of sound and video recording devices, with the exception of mobile phones, bottles, glasses, cans, sticks, weapons, pyrotechnics, and other items listed in the house rules of the event venue, is prohibited.
RESALE, FORGERY, OR ANY OTHER FORM OF TICKET MISUSE IS NOT PERMITTED AND IS PUNISHABLE!
The traveler must keep the ticket at least until the end of the event or leaving the event venue. The barcode on the ticket is unique and is only valid on the first scan; any further copying and any further passage is not possible. In case of a lost ticket, its replacement is not possible.
The ticket buyer must protect the ticket from unauthorized access. CMT assumes no responsibility for any problems that would arise due to intermediation, sharing of information, copying, etc. The organizer reserves the right, in case of misuse, to deny entry to ticket holders with identical barcodes.
XIX. PROTECTION OF PERSONAL DATA
CMT D.O.O. protects all data about travelers in accordance with the General Data Protection Regulation (GDPR) or the corresponding domestic legislation on the protection of personal data (ZVOP-1).

Categories of personal data
The acquired data of travelers that the controller has obtained for the purposes of performing the contract and which the controller of the personal data collection stores are:
• email address;
• name and surname, and title or gender;
• company name;
• physical address;
• telephone;
• mobile phone;
• birth data;
• personal document data;
• data on the ordered package and any additional ordered services;
• data on the payer of the package, if different from the traveler's data;
• payment data (type of payment, payment data);
• any traveler's notes or special requests;
• past inquiries, purchases, invoices, support requests.
The acquired data of website users stored by the controller of the personal data collection are:
• data on which pages the user visited on the portal or how far they got in the package purchase process;
• data provided by the user's browser or mobile device, such as the user's IP address, location data, device identifier (IMEI number, MAC address), browser data, data on how the traveler came to the website, operating system;
• data from cookies and other methods of storing data in the user's terminal equipment;
• time and duration of the visit;
• past inquiries, purchases, invoices, support requests.
The acquired data of e-newsletter users stored by the controller of the personal data collection:
• email address;
• which messages the user opened and which links in the messages they clicked;
• which pages they visited on the portal;
• past inquiries, purchases, invoices, support requests;
• user IP addresses;
• data from cookies and other methods of storing data in the user's terminal equipment.
The acquired data about phone calls, email messages, or chats via our websites stored by the controller of the personal data collection:
• your phone number, email message, or username and IP address;
• the content of your message.
The acquired data about participants in prize games and surveys stored by the controller of the personal data collection:
• name;
• age;
• email address or phone number;
• data required for the execution of the prize game or survey.
Purposes of personal data processing
The controller will use the data it has obtained from travelers and website users for the following purposes:
• for the performance of the contract;
• for communication with the contractual or (pre)contractual relationship;
• for the execution of prize games and surveys;
• for statistical and market analysis; tracking clicks and opening of emails and clicks on the website for segmentation and adaptation of email content;
• informing and sending e-newsletters, articles, event announcements by email;
• direct marketing and sending offers via SMS/MMS, email and notification messages, conventional mail, on the website and mobile applications, and making phone calls;
• segmentation, profiling, and automated processing for the purpose of creating customized messages and offers that will be more relevant to the user;
• displaying customized ads on advertising platforms (Google and Facebook).
When sending electronic messages, the controller records the opening of received messages by individuals and clicks on links in the received messages. It also records views and actions on the controller's website. For better and more targeted provision of offers and personalization of messages or communication, the recorded data are automatically processed, analyzed, and evaluated for activity and measuring user interest.
Retention period
We store travelers' personal data for five (5) years after the completion of the package (the limitation period for asserting liability for damages from travel under the second paragraph of Article 352 of the Obligations Code). Deletion is performed annually on July 1 for all data that should have been deleted in the previous calendar year.
We store personal data in other collections for five (5) years after their entry, or until the cessation of the legal basis or legitimate interests for their continued retention. Deletion is performed annually on July 1 for all data that should have been deleted in the previous calendar year.
If retention is based on the individual's consent, we will effectively and permanently delete their personal data within 15 days of the withdrawal of that consent.
Legal basis
It is considered that by signing the contract, the traveler agrees to the use of their personal data, which they provided on the registration form, for the purpose of fulfilling the contractual obligations and rights and for communicating with the traveler regarding the contractual or pre-contractual relationship. In the event that the traveler as the payer of the trip also orders for other travelers, it is further considered that they have previously obtained the consent of the other travelers for the processing of their personal data for these purposes.
It is also considered that by signing the contract, the traveler also consents to the use of data from the registration form for the purposes of direct marketing (informing about the offer of the controller and its business partners), customer segmentation, statistical processing, and market research. The consent is valid until revoked, which the traveler can submit personally to the controller, by phone, by mail, or by email. If the traveler explicitly does not want the data to be processed for these purposes, they can state this as a note on the travel registration form.
Direct marketing of the controller's offers by email is also permitted on the basis of Article 72 of the Personal Data Protection Act (ZVOP-1) or Article 158 of the Electronic Communications Act (ZEKom-1). Notifications are sent periodically and are clearly marked as such. The recipient is provided with a clear and explicit option in each message, through an appropriate link, to easily and free of charge refuse further receipt of messages.
Direct marketing, customer segmentation based on their past purchases or expressed interest in purchases, and the execution of statistical processing and market research are also permitted because they are necessary to achieve the legitimate interests pursued by the controller. Like any other company, the controller strives to offer better and more targeted offers to its customers or potential customers, thereby persuading them to order new or additional services. For this purpose, it also collects data on the use of its website, email messages, or other types of messages. The controller notes that this practice is also common in other companies in the industry or more broadly, and at the same time, it does not detect that the state supervisory authority has significantly restricted or prohibited it in its work to date (at least as it appears from the annual report of the state supervisory authority or its public announcements). At the same time, the controller emphasizes that individuals have significant options, through appropriate settings in their profiles with advertising intermediaries (Google, Facebook), to appropriately limit the possibilities of using their data for direct marketing purposes. Consequently, the controller assesses that these activities do not lead to a situation where the interests or fundamental rights and freedoms of the individual to whom the personal data relate would outweigh its legitimate interests to offer the best possible service.
Protection of personal data
The controller will protect the acquired data in accordance with the valid legislation on the protection of personal data and in accordance with its internal acts. It will ensure appropriate organizational and technical protection.
The controller will not forward or disclose the acquired data to third parties, unless it is necessary for the very performance of the package (e.g., to providers of tourism facilities, as stated below in the section on contractual processing), to fulfill a court order or similar request from competent authorities, or to assert, exercise, or defend the legal claims of the controller.
User rights
In accordance with the provisions of the EU General Data Protection Regulation (GDPR), the personal data controller must, at the individual's request:
• Confirm whether data relating to them is being processed or not, and allow them access to their personal data;
• Provide the option to correct or supplement their personal data.
• Provide the option of partial or complete deletion of personal data when the personal data are no longer necessary for the purposes for which they were collected or otherwise processed, and in some other cases, and the option to object when personal data are processed on the basis of the controller's legitimate interests;
• Provide the option to temporarily restrict the processing of personal data in certain cases;
• Provide the option of partial or complete withdrawal of consent for the processing of personal data. The controller will respect your wish to withdraw consent and will effectively and permanently delete your personal data within 15 days when there is no other legal basis for the processing.
An individual can exercise the rights from the above list by writing to us at the address CMT D.O.O., Šmartinska c. 152, or by email to info@cmt.si. In their request, they must state their identification data, the content of the request, and the justification for the request. The response will be provided within one month of receiving the request. This deadline may be extended by a maximum of two additional months if necessary, taking into account the complexity and number of requests.
If any individual believes that their rights regarding the protection of their personal data have been violated by the controller, they can at any time file a written objection with the controller at the address CMT D.O.O., Šmartinska c. 152, Ljubljana or file a complaint with the supervisory authority (Information Commissioner, Dunajska 22, 1000 Ljubljana, gp.ip@ip-rs.si).
Every user has the option to easily unsubscribe from receiving messages with one click in the footer of the received email message or by sending an email with the unsubscribe request to info@cmt.si or by replying to the specific received email message.
Contractual processors and storage area
The controller also forwards the collected personal data of travelers to its contractual processors, who can process the data exclusively within the controller's instructions and authorizations and who are bound by a written contract concluded with the controller to ensure an appropriate level of personal data protection, namely for:
• the performance of individual services from the tourism package;
• customer data management (CRM),
• email marketing system,
• marketing automation system.
The provider stores personal data collections within the EU and does not transfer them to third countries.
The controller may forward personal data to digital advertising platforms (Google, Facebook, LinkedIn, and similar) and use their cookies, which allow the controller to create more precise segments, display targeted ads, and re-market. This allows the user to receive more relevant ads on these platforms from the controller. This may involve the transfer of data to a contractual processor outside the EU.

XX. SPECIAL PROVISIONS OF THE CONSUMER PROTECTION ACT
Extracts from the Consumer Protection Act (ZVPot-1) related to the organization of tourism packages:
Application: ZVPot-1 applies exclusively to consumers
Scope of application: ZVPot-1 applies exclusively to tourism packages and not to other tourism services.
Event: Deadline:
Possibility of trip cancellation due to an insufficient number of registered participants: notification to travelers no later than 20 days before departure.
Price increase: only due to changes in fuel prices, tariffs, exchange rates, taxes, fees - traveler informed at least 20 days before departure, possibility of withdrawal from the contract on the part of the traveler if the increase is higher than 8% of the package value.
Deadline for a complaint: 2 years from the occurrence of non-conformity with the contract.
Change to a reservation at the traveler's request: less than 9 days before departure, changes are not possible, and any change is considered a withdrawal from the contract. If the parties agree on any change, an administrative fee of 15.00 EUR will be charged.
XXI. INSOLVENCY AND PROTECTION IN CASE OF THE AGENCY'S LIQUIDITY DIFFICULTIES
CMT will enable travelers to return home in the event that the provider becomes insolvent during the traveler's trip. In the event of unavoidable circumstances, e.g., terrorist attacks or natural disasters, CMT will provide travelers with accommodation of a similar standard to the accommodation on the trip. The organizer will reimburse travelers for costs up to a maximum of three nights. This applies only to cases where a timely return home is not possible. The limitation of costs does not apply to persons with reduced mobility, including persons accompanying them, pregnant women, unaccompanied minors, and persons who need special medical assistance, if the tour organizer was informed of their special needs at least 48 hours before the start of the tourism package.
CMT, as the tour organizer, provides a guarantee for the reimbursement of all payments that have been made by the traveler or on their behalf if individual travel services were not performed due to CMT's liquidity difficulties. In the event that the agency's liquidity difficulties affect the performance of a trip or package that has already started, the guarantee also includes the free provision of return for travelers and the financing of accommodation before return, if necessary.

Subject of the insurance guarantee: a guarantee for the reimbursement of all payments that have been made by the consumer or on their behalf if individual travel services were not performed due to the tour organizer's liquidity difficulties.
Information on the assistance center at Zavarovalnica Triglav, d.d., which provides consumers with an assistance service in the event of the tour organizer's liquidity difficulties. Liquidity difficulties, in accordance with valid legislation, occur when the tour organizer is unable to fulfill contractually agreed-upon obligations in a timely manner. In the aforementioned case, the consumer calls on the tour organizer to ensure the fulfillment of contractual obligations within 48 hours and to provide appropriate proof for this. If the obligations are not fulfilled after the expiration of the specified deadline, the consumer contacts the assistance center, which in the next 72 hours ensures the reimbursement of costs in accordance with the guarantee under the valid Guarantee Letter for insurance against liquidity difficulties.

XXII. FINAL PROVISIONS
All prices in CMT programs include value-added tax (VAT). Vouchers that CMT awards for promotional purposes can be redeemed exclusively at regular sales prices, unless otherwise specified on the voucher. CMT is not responsible for the actions and damages that travelers may cause during the trip. The traveler confirms that they agree to the risks associated with participating in the trips or events organized by CMT, potovalna agencija d.o.o., and therefore will not assert any claims for compensation against the organizer. The traveler also agrees that the organizer may publish data, photos, recordings, and statements in public media without requiring any reimbursement from them. The organizer will process the personal data of registrants in accordance with the law and the privacy policy. In the event of a dispute between the parties, the court in Ljubljana is competent to resolve them. CMT is not responsible for any errors in promotional material (catalogs, programs on sheets and websites). With these general terms and conditions, the general terms and conditions of an older date cease to be valid.
With the publication of these general terms and conditions, the previous general terms and conditions cease to be valid.

The festival is taking place in Novalja, the Island of Pag. CMT travel agency d.o.o. acts as the responsible organizer of package deals, and not as the organizer of the festival. Therefore, the general terms and conditions apply to package deals, and the following conditions apply to festival tickets:

This means that if the customer cancels the reservation, the cancellation costs are divided:

No later than 5 days before departure, all clients will receive an email notification of their departure with all the detailed information they need to leave on their travels.
Mandatory surcharges at the destination (if the reservation holds an accommodation):
- Security deposit 50-100 € / person (returned at check-out, if the accommodation is in the same condition as at check-in)
Please check the conditions for crossing borders before departure. Refusal at the border due to non-fulfillment of the conditions for crossing is considered a termination of the travel contract by the passenger and is not a reason for claiming cancellation risk insurance.
The "Balkan Wave" program is not suitable for persons under the age of 18. Therefore, we reserve the right to dismiss a minor who would still make a reservation before departure without special compensation/and we do not allow them to use the reserved services.
